How we work, in writing.

These apply when you instruct us on a job, unless we have signed something different with you.

Before launch: have this reviewed by a solicitor or your professional body. It is a solid, honest draft written for a small property maintenance business. It is not legal advice, and it needs your real details filling in.

1. Who you are contracting with

C2P Property Maintenance is a sole trader business, trading from 28 Mersey Road, Biggleswade, Bedfordshire, SG18 8NQ. In these terms, "we" is that business and "you" is the agency, property manager or landlord instructing us.

Gas work is carried out by DS Plumbing & Heating, Gas Safe registered no. 969794, a separate sole trader business. Where a job includes gas work, that part of the contract is with them, and we will tell you so before the work starts.

2. Instructing us

A job starts when we confirm we accept it, by phone, WhatsApp, email or the form confirmation. Sending us a job does not by itself create a contract, we may decline work that is outside our trades or our area, and we will tell you promptly if so.

3. Access

You are responsible for having the right to instruct work at the property and for the tenant being told we are coming. We will contact the tenant to arrange access where you give us their details.

If we attend a booked appointment and cannot get in, we charge the no-access fee on the price list and tell you the same day.

4. Prices, quotes and authorisation

The prices on the price list apply to the jobs listed there. Everything else is quoted after a diagnosis visit; the diagnosis or call-out fee is payable whether or not you accept the quote.

We will not exceed your stated spend limit without speaking to you first. If you have not given us one, we use £150. Where an unauthorised overspend is unavoidable to make a property safe, we will do the minimum needed and tell you immediately.

Parts are charged at cost plus 15% and itemised. C2P Property Maintenance is not VAT registered, so no VAT is added.

5. Timescales

The attendance times on the agent page are the standard we work to and we will tell you as soon as we know we will miss one. They are attendance times, not completion times, and they do not apply where access, parts availability or a third party prevents it.

6. Payment

Invoices are due 30 days from the invoice date, by bank transfer. We may charge interest and reasonable recovery costs on late payment under the Late Payment of Commercial Debts (Interest) Act 1998, though we would rather ring you.

Where you have asked us to invoice a landlord directly and they do not pay, the debt reverts to you unless we agreed otherwise in writing before the work.

7. Our work

We will carry out work with reasonable care and skill, using materials of satisfactory quality, in line with the Supply of Goods and Services Act 1982 and the Consumer Rights Act 2015 where it applies.

We guarantee our labour for [12 months] from completion. Parts carry the manufacturer's warranty and we will pursue it on your behalf. The guarantee does not cover fair wear and tear, tenant misuse, a fault in a part you supplied, or work we advised against and you instructed anyway.

8. What we do not do

Electrical work, locksmithing, roofing, decorating, and anything above ladder height. Where we arrange a specialist partner we will tell you who they are; they are responsible for their own work and their own insurance, and we will tell you before the job whether they are contracting with you or with us.

9. Liability

We hold public liability insurance of £5,000,000 and employers' liability insurance of £5,000,000. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise our liability for any one job is limited to [the greater of the invoice value of that job and £0,000], and we are not liable for loss of rent, loss of profit or other indirect loss.

We are not liable for damage caused by a pre-existing defect we have pointed out to you in writing and been told not to fix.

10. Cancellation

Cancel a booked job more than [24 hours] before the slot and there is no charge. Inside [24 hours], or if we have already collected parts, we charge [the call-out fee plus any parts].

11. Complaints

12. Data

Handling of your data and tenant data is set out in the privacy notice, which forms part of these terms.

13. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
